Dilapidations are the state of disrepair of a commercial (non-domestic) property that occurs when a tenant fails to meet their legal and financial obligations to maintain and repair the property together with related matters such as the reinstatement of alterations. These obligations are set out within the lease agreement between a landlord and tenant and often lead to disputes over interpretation and application.

Cademuir Building Consultants (CBC) have extensive experience in this specialist field and regularly represent either Landlords or Tenants with mid-term and lease-end dilapidation negotiations in Scotland and northern England.

Representation services include:

  1. Preparation of Schedules of Dilapidations on behalf of Landlords
  2. Tenant representation assessing and responding to a Landlord’s Schedule of Dilapidation.
  3. Active management of negotiations to achieve a pragmatic conclusion providing sensible and robust advice at all stages.
  4. Advising Tenants mid-lease term on their dilapidation obligations to inform how best to mitigate associated costs and a Landlord’s damages claim.
  5. Dilapidation Liability Assessments which assess current and future dilapidation liabilities. These are essential for tenants at the pre-lease agreement stage or for investors (landlord or tenant) prior to a lease or business acquisition.
